This Legal Disclaimer delineates the scope, limitations, and conditions under which Commissioner of Oaths Edmonton™ provides commissioning services in and for the Province of Alberta. It is intended to clearly define our role as a Commissioner for Oaths, distinguish our services from those of a Notary Public or Lawyer, and allocate responsibility appropriately between the service provider and the client. By accessing this website and/or booking an appointment with us, you acknowledge and accept the terms outlined below.
All Commissioner for Oaths services provided by Commissioner of Oaths Edmonton are in accordance with Alberta legislation governing Commissioners for Oaths and under the authority of the Alberta Ministry of Justice and Solicitor General.
1.1 The information contained on this website is provided for general informational purposes only and does not constitute legal advice, legal opinion, or legal representation.
1.2 Accessing this website, submitting an inquiry, communicating with us, or booking an appointment does not create a solicitor-client relationship, fiduciary relationship, or any other professional advisory relationship. Only a lawyer licensed under the Legal Profession Act, RSA 2000, c L-8 is authorized to provide legal advice in the Province of Alberta.
2.1 We provide Commissioner for Oaths services solely within the scope authorized under Alberta law. Pursuant to the Notaries and Commissioners Act, RSA 2000, c C-20, and applicable regulations, policies, and directives issued by the Province of Alberta, a Commissioner for Oaths is authorized to:
administer oaths and affirmations; and
take and receive affidavits, statutory declarations, and solemn declarations, for use where commissioning by a Commissioner for Oaths is legally sufficient.
2.2 Commissioned documents will be endorsed in accordance with statutory form requirements, including the commissioner’s name and the phrase “A Commissioner for Oaths in and for Alberta,” and the expiry date of the commission where applicable.
2.3 Our services are strictly limited to these functions.
3.1 Except where expressly stated otherwise in writing, we do not:
provide legal advice, legal interpretation, or legal representation;
draft, complete, edit, review, or assess the legal sufficiency, enforceability, or appropriateness of any document;
certify true copies of documents as notarized copies;
act as a Notary Public.
3.2 A Commissioner for Oaths does not possess the powers of a Notary Public solely by virtue of appointment as a commissioner. The authority and powers of a Notary Public are governed separately under the Notaries Public Act, RSA 2000, c N-3, and include broader functions not available to Commissioners for Oaths.
4.1 Our authority as a Commissioner for Oaths arises solely under the laws of the Province of Alberta.
Any commissioning performed from a home office, at a mobile location, or through virtual means remains subject to Alberta jurisdictional limitations. We make no representation or guarantee that documents commissioned within Alberta will be accepted outside Alberta or Canada, or by any authority that requires notarization, legal advice, or in-person execution under its own governing rules.
4.2 Documents intended for use outside the Province of Alberta or Canada may require notarization by a Notary Public or legal professional recognized in the relevant jurisdiction, and commissioning here does not guarantee acceptance elsewhere.
5.1 We make no representation, warranty, or guarantee—express or implied—that any document commissioned by us will be accepted by a court, tribunal, registry, government department, financial institution, employer, foreign authority, or any other third party.
5.2 Acceptance requirements vary by jurisdiction, institution, document type, and intended use. It is the sole responsibility of the client to confirm, prior to the appointment, whether commissioning by a Commissioner for Oaths (as opposed to notarization or legal certification) is acceptable for the intended purpose. We do not assess or determine whether a document satisfies the specific procedural, evidentiary, or formal requirements of any receiving authority.
6.1 You are solely responsible for:
the content, accuracy, completeness, and legality of any document presented for commissioning;
presenting valid, authentic government-issued photo ID; and
the truth and accuracy of any statement sworn or affirmed.
6.2 A Commissioner for Oaths' role is limited to verifying identity and administering the oath or affirmation in accordance with Alberta standards and guidance. We do not verify, investigate, or confirm the factual accuracy of statements contained in any document.
6.3 Clients are strongly advised to seek independent legal counsel to draft, review, and fully understand the legal content and consequences of any document prior to commissioning. The provision of legal advice, document preparation, and legal interpretation constitutes the practice of law and may only be performed by a lawyer licensed under the Legal Profession Act, RSA 2000, c L-8. Commissioners for Oaths are neither authorized nor qualified to provide such services, and no responsibility is assumed in this regard.
6.4 Making a false statement under oath or affirmation may constitute an offence under the Criminal Code of Canada, RSC 1985, c C-46, including provisions relating to perjury and false declarations. Identity verification is limited to reviewing identification presented at the time of commissioning and does not constitute authentication or validation of the genuineness or legal validity of any identification document.
6.5 Commissioning must comply with the statutory Code of Conduct for Commissioners for Oaths set out under the Notaries and Commissioners Act and associated regulations, and we will not participate in the preparation or delivery of documents that are false, incomplete, misleading, deceptive, or fraudulent.
7.1 By proceeding with commissioning services, the client represents and warrants that they understand the nature and effect of the document and the oath or affirmation being administered, and that they are acting voluntarily and without coercion.
7.2 We do not assess legal capacity, provide explanations of legal consequences, or translate documents. Where language barriers, comprehension issues, or concerns regarding understanding arise, service may be refused by the Commissioner for Oaths.
8.1 We reserve the right to refuse or discontinue service where permitted or required by law, including (without limitation) where:
satisfactory identity cannot be reasonably confirmed;
a document appears incomplete, altered, irregular, or outside our statutory authority;
there are reasonable concerns regarding duress, coercion, incapacity, or misunderstanding; or
the requested service would contravene applicable law or professional standards.
Such refusal may be exercised where required or permitted under the Notaries and Commissioners Act, associated regulations, or the statutory Code of Conduct governing Commissioners for Oaths.
8.2 Nothing in this disclaimer obligates us to provide services where refusal is lawful or prudent.
Services may be provided from a private home office by appointment only. This is not a public office, retail storefront, or government facility. Walk-in services are not available unless expressly advertised or confirmed in advance.
10.1 Where services are provided at a client-selected location, we do not control or assume responsibility for the condition, safety, legality, or suitability of the premises.
10.2 Clients are responsible for ensuring that the location is safe, lawful, and appropriate for commissioning services. We reserve the right to decline or discontinue mobile services at any location where safety, legality, or professional appropriateness is in question.
11.1 Where services are provided virtually, we are not responsible for technical failures, interruptions, transmission errors, data loss, compatibility issues, or delays arising from internet connectivity, hardware, software platforms, or third-party communication tools.
11.2 Clients are responsible for ensuring adequate technology, connectivity, document access, and functionality necessary to complete the appointment.
12.1 This website may contain links to, or integrations with, third-party websites or services, including but not limited to online booking platforms, mapping services, or communication tools.
12.2 We do not control and are not responsible for the content, accuracy, availability, security, privacy practices, or terms of use of any third-party websites or services. Use of such services is governed solely by the applicable third party’s terms and policies.
We operate as an independent sole proprietorship. Although Commissioners for Oaths are appointed under the Commissioners for Oaths Act, RSA 2000, c C-20, such appointment confers limited statutory authority only and does not create an employment, agency, or representative relationship with the Government of Alberta or any governmental authority. Commissioners for Oaths provide services independently, may charge fees for their time and services, and do not act on behalf of, or bind, the Crown in any legal capacity.
We are not liable for any failure or delay in providing services resulting from events beyond our reasonable control, including but not limited to severe weather, power outages, internet disruptions, illness, emergencies, or government restrictions.
To the maximum extent permitted by applicable law, including the laws of the Province of Alberta and the federal laws of Canada, we expressly disclaim all liability for any loss, damage, cost, expense, claim, or consequence—whether direct, indirect, incidental, consequential, special, exemplary, or otherwise—arising out of or related to:
(a) use of this website or reliance on any information contained herein;
(b) the provision, refusal, delay, or discontinuance of Commissioner for Oaths services;
(c) the form, content, accuracy, completeness, truthfulness, or legal effect of any document presented for commissioning;
(d) the acceptance, rejection, delay, or non-acceptance of any document by a court, tribunal, registry, government department, financial institution, employer, or any other third party; or
(e) the success, failure, effectiveness, or legal outcome of any matter, transaction, application, or proceeding for which a commissioned document is used or intended to be used.
The act of commissioning a document constitutes a ministerial act limited to administering an oath or affirmation and witnessing execution as authorized under the Commissioners for Oaths Act, RSA 2000, c C-20. Commissioning does not constitute verification of the truth, legality, accuracy, or enforceability of any statement or document, nor does it confer any approval, endorsement, or validation of the document’s purpose or intended outcome.
Responsibility for the truth and accuracy of any statement sworn or affirmed rests solely with the person making the statement. Making a false statement under oath or affirmation may constitute an offence under the Criminal Code of Canada, RSC 1985, c C-46, including offences relating to perjury and false declarations. We assume no liability for any consequences arising from false, misleading, incomplete, or fraudulent statements contained in any commissioned document.
Commissioning a document does not guarantee, imply, or warrant that the document will achieve its intended legal, administrative, or practical purpose. We expressly disclaim liability for any adverse, neutral, or unsuccessful outcome resulting from the use of a commissioned document, including where such outcome arises from defects in drafting, misunderstanding of legal requirements, jurisdictional limitations, or third-party decision-making.
Except where required by law, we do not retain, store, or maintain copies of documents commissioned, nor do we assume responsibility for the preservation, confidentiality, or future availability of any document once commissioning is completed.
We do not advise on what type of document is needed, how to complete it, or whether a particular commissioning will meet a third party’s requirements.
We are not responsible for any third-party interpretation, modification, or reliance on commissioned documents beyond our immediate commissioning act.
No fiduciary duty, duty of care, or professional obligation arises beyond the limited statutory functions performed as a Commissioner for Oaths. Any duty owed is confined strictly to administering the oath or affirmation in accordance with applicable law.
We have no obligation to monitor, follow up on, advise regarding, or otherwise involve ourselves in the use, filing, submission, or outcome of any commissioned document after the commissioning service has been completed.
This limitation of liability applies regardless of the legal theory asserted, including contract, tort, negligence, misrepresentation, breach of duty, or otherwise, and survives the completion or termination of any service.
This Legal Disclaimer constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes any prior or contemporaneous communications, representations, or understandings, whether written or oral.
This Legal Disclaimer is governed by and shall be construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-laws principles. The parties irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Alberta for any dispute arising out of or relating to this Legal Disclaimer, the use of this website, or the provision of Commissioner for Oaths services.
If any provision of this Legal Disclaimer is found to be invalid, unlawful, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
